These Terms of Service (“Terms”) govern your access to and use of CloudSave (“CloudSave”, “we”, “our”, or “us”), available at cloudsave.app, including all related services, software, and tools (collectively, the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of the Service

CloudSave provides automated database backup services, including but not limited to:

  • Cloud-based backups (no agent required)
  • Agent-based backups installed on your server
  • Scheduled and on-demand backups
  • Table-level database backups
  • Secure storage and restore functionality

The Service is designed to assist users in protecting and restoring database data. CloudSave does not guarantee prevention of data loss.

2. Eligibility & Account Responsibility

You must be at least 18 years old to use the Service.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that you have the legal right to access and back up the databases you connect to CloudSave

CloudSave is not responsible for unauthorized access caused by compromised credentials.

3. User Responsibilities

You agree that you will:

  • Use the Service only for lawful purposes
  • Ensure compliance with all applicable data protection and privacy laws
  • Not use the Service to store or back up illegal content
  • Properly configure backup schedules, retention, and restore settings

You acknowledge that misconfiguration, incorrect credentials, or external infrastructure failures may result in incomplete or failed backups.

4. Data & Security

  • CloudSave encrypts data in transit and at rest using industry-standard methods.
  • In Agent Mode, you are responsible for the security and integrity of the server where the agent is installed.
  • You retain full ownership of your data at all times.

CloudSave does not access your data except as required to provide the Service or comply with legal obligations.

5. Backups & Restores (No Guarantee Clause)

While CloudSave is designed to reliably perform backups and restores:

  • We do not guarantee that every backup will be successful
  • We do not guarantee that restored data will be complete or error-free
  • You are solely responsible for verifying backup integrity and restore results

CloudSave should be used as part of a broader data protection strategy.

6. Table-Level Backups

Table-level backups are provided as a convenience feature:

  • Availability may vary depending on database engine and configuration
  • Restoring individual tables may overwrite existing data
  • You are responsible for understanding the impact of table-level restores

CloudSave is not liable for data inconsistencies resulting from partial restores.

7. Plans, Billing & Payments

  • Paid plans are billed according to the pricing page at the time of purchase
  • Fees are non-refundable unless explicitly stated otherwise
  • We may modify pricing or plans with reasonable prior notice

Failure to pay may result in suspension or termination of access to the Service.

8. Suspension & Termination

We reserve the right to suspend or terminate your access if you:

  • Violate these Terms
  • Abuse the Service or infrastructure
  • Use the Service in a way that poses legal or security risks

You may terminate your account at any time.

9. Service Availability

The Service is provided on an “as is” and “as available” basis.

We may:

  • Perform maintenance
  • Modify features
  • Temporarily interrupt access

We are not liable for downtime or data loss caused by external systems, networks, or force majeure events.

10. Limitation of Liability

To the maximum extent permitted by law:

CloudSave shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to data loss, business interruption, or loss of profits.

Our total liability shall not exceed the amount paid by you for the Service in the preceding 12 months.

11. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
